Lourdes M. Turrecha is an associate attorney in Arent Fox’s San Francisco office. Her practice is focused on privacy, data security, advertising, and intellectual property. Lourdes is experienced in helping organizations develop their privacy and data security programs and is knowledgeable in international (e.g. GDPR, EU-US Privacy Shield), federal (e.g. HIPAA, GLBA, COPPA), state, and local privacy laws; industry standards (e.g. PCI DSS); and privacy and security frameworks (e.g. NIST, GAPP, ISO, FedRamp). She is also experienced in reviewing promotional materials and registering trademarks.

Previous Work

Prior to joining Arent Fox, Lourdes was a consultant on law and policy for a company that develops software training for organizations to use in spreading awareness on protecting privacy, minimizing data security breaches, and dealing with online social media issues. She was also the Senior Policy Manager of Privacy for an international gaming, hospitality, and entertainment company, where she helped build their privacy program from the ground up. During law school, she clerked for the General Counsel of a multinational corporation, where she handled a wide range of day-to-day legal issues that covered privacy, trademarks, and promotions, amongst others. She was also a privacy research associate for one of the leading privacy law scholars.

Consumer Review Fairness Act of 2016: What Brands Need to Know About This New Consumer Review Law

What’s the News?

Before leaving office, President Obama signed into law the Consumer Review Fairness Act of 2016 (CRFA), which protects consumers engaging in consumer reviews. The CRFA voids a contract if it prohibits or restricts an individual from reviewing a seller's goods, services, or conduct.

Who is Affected?

All companies that have the prohibited clauses (see below) in their consumer contracts will have to review and update these contracts for compliance with the CRFA.

New Version of Payment Card Information Standards Targets Recent Breach Issues

What’s the News?

Following recent updates, merchants and retailers will soon become subject to the updated Payment Card Information Data Security Standard (PCI DSS), the security standard that organizations need to follow if they handle credit and debit cards from major card companies, such as Visa, MasterCard and American Express. This round of changes will be known as version 3.2 of PCI DSS, and include significant guidance and updates on hot topics such as encryption and strong credentials. Compliance with the changes is important because companies that are subject to PCI DSS but fail to comply face exclusion from processing credit card payments and/or hefty fines. Sometimes, noncompliance could mean leaving open the doors to your cardholder data environment, thereby allowing hackers and malicious entities to enter.

What Global Fashion Companies Need to Know About the GDPR If They Collect EU Personal Data

What’s New? (The GDPR.)

Fashion and luxury goods companies need to take heed of yet another data protection regulation. This one could substantially impact them if they collect, process, or transfer EU individuals’ personal data, or plan to do so at some point soon. Specifically, the General Data Protection Regulation (GDPR) is the EU’s new data protection law, recently and finally entered into law. It replaces the old EU data protection regime established by the Data Protection Directive (95/46/EC). The GDPR lays out requirements for organizations that process EU residents’ data and generally provides people increased control over their personal data.
